NASHVILLE, TN. (WLAF)- A law passed during the 2024 Tennessee Legislative was amended this year to ensure legal notices aren’t restricted to a single source for publication.  

In this year’s session HB773/SB760 added to the already adopted list of criteria that became law last year. CLICK HERE too see the list of criteria.

The bill was sponsored by Dennis Powers, 36th District State Representative and co- sponsored by Ken Yager, 12th District State Senator.

Gov. Bill Lee signed the legislation on May 21 making it law as of July 1.

The addendums are:

-The website posting the notice must not require a fee or a subscription for a person to view the website.

-The website must be a separate and distinct website from the newspaper of general circulation that is owned by an entity other than the newspaper of general circulation.

The new law requires that the owner of a website where legal notices are published:

 -Charge a rate for such publication that is calculated by the word.  The rate for each word must be comparable, but must not exceed, the established rates the owner charges other advertisers

-Include on the invoice to the person or entity paying for such publication an affidavit listing the number of days the notice was published on the website.

This amendment exempts sales of land to foreclose a deed of trust, mortgage, or other lien from the requirements from the internet publication requirements of present law and this bill. Another piece of legislation (HB1127/SB727) changed how those notices are published.

 As the bill made its way through the process, another amendment was added. An exemption was provided for the publication of sample ballots.

Beginning July 1, WLAF will be publishing all notices that were previously only required to be published in a newspaper.
