DUFF, TN (WLAF) – In the early hours of May 6, two broken taillights caught the attention of Campbell County Sheriff’s Deputy Preston Mullins while he was patrolling White Oak Rd. Mullins stopped the camo colored Suzuki and made contact with the driver, Donald Caldwell and the rear seat passenger Kathryn Jewell Rosales. Rosales had two small children that appeared to be toddler age sitting in Rosales’ lap without a seatbelt on, according to a report from the sheriff’s department.

Mullins detected the smell of alcoholic beverages coming from inside the Suzuki and the windshield of the vehicle was shattered. He also noticed the cab was filled with broken glass. At this point, Mullins asked the driver of the vehicle if he had crashed, and he replied that Rosales was the one who wrecked. She then leaned forward and stated, “Yeah I hit a tree.” Mullins noted in the report that she appeared to have dried blood around the mouth and nose area of her face.

Rosales and Caldwell were asked to step out of the vehicle. Rosales said she had wrecked near Tackett Creek in the mountains about a half hour earlier. Mullins asked if she had consumed any alcoholic beverages to which she replied she had consumed one Bootlegger Peach Liquor approximately an hour before the traffic stop. She continued that both of her children, who were currently in the vehicle, were in the vehicle at the time of the crash. Mullins opened the passenger door to check the well-being of the children. As Mullins entered, he noticed both the front seat and back seat areas were filled with glass shards. He also noticed that both children were also sitting on shards of glass, and neither child was securely fastened in a child safety seat. There were no child safety seats in the Suzuki.

Mullins asked the children if they were okay, and one of the children replied, “We had a crash.” Also inside the vehicle was a broken bottle of Bootlegger Peach Liquor in the passenger seat, as well as an unopened bottle of the same liquor in the center console, according to the report. Rosales was given a series of field sobriety tests on which she performed poorly.

While Mullins was searching Rosales, he found a nasal shot of Narcan in her back pocket. Mullins asked Rosales if she had taken any drugs that she would need Narcan for, she allegedly replied “no drugs, just alcohol.” She was then asked if she had attempted to report the accident or had any intentions of reporting it to which she denied.

Rosales, 40, 6442 North Hwy 25, Duff was charged with driving under the influence (DUI), open container law, child endangerment, child restraint law, seatbelt law and failure to report an accident. (WLAF NEWS PUBLISHED – 05/14/2021-6AM)
